On March 10, 2021, the House of Representatives voted 225-202 to approve an amendment to H.R. 1446, the Enhanced Background Checks Act of 2021. This vote moved the legislation forward, which aims to extend the time federal authorities have to complete background checks for gun purchases from three business days to ten. Under current law, if the FBI does not complete a background check within three business days, a licensed dealer is permitted to sell the firearm to the buyer; this bill seeks to close what is often called the "Charleston Loophole" by requiring more time for a definitive "proceed" or "denied" status. The vote followed strict party lines, with nearly all Democrats voting in favor and the vast majority of Republicans voting against it. While seven Republicans joined the Democratic majority to pass the measure, the outcome reflects a significant partisan divide over federal firearm regulations.
